Terms of Service

Welcome to Fork PDF. These Terms of Service ("Terms") govern your access to and use of the Fork PDF website, API, and related services (collectively, the "Service"). By creating an account or using our API, you agree to be bound by these Terms.

Fork PDF is operated out of New Delhi, India. If you do not agree to these Terms, you may not use the Service.

1. Account Registration & Security

To use our API, you must register for an account. You agree to:

• Be at least 18 years old.
• Provide accurate and current information.
• Keep your API keys and passwords completely confidential. You are strictly responsible for all activity (and API credit usage) that occurs under your account credentials.

As outlined in our Privacy Policy, accounts that remain completely inactive for a continuous period of 6 months may be permanently deleted to optimize infrastructure resources.

2. Acceptable Use Policy (AUP)

Fork PDF is a developer tool designed to generate legitimate business documents. You agree not to use our API to:

• Generate, host, or distribute illegal content, including but not limited to Child Sexual Abuse Material (CSAM), non-consensual explicit content, or content that promotes terrorism.
• Generate documents intended for phishing, social engineering, scams, or distributing malware.
• Infringe upon the intellectual property rights, copyrights, or trademarks of others.
• Attempt to bypass API rate limits, reverse-engineer our rendering engine, or launch denial-of-service (DDoS) attacks against our edge infrastructure.

Violation of this AUP will result in immediate, permanent account termination without a refund.

3. Infrastructure Modes & Responsibilities

Fork PDF offers two distinct storage paradigms. Your responsibilities differ based on the mode you select:

A. Managed Hosting

We handle the infrastructure, generation, and temporary storage of your PDFs via AWS S3. We guarantee that your documents will be automatically deleted upon the expiration of your chosen retention period (24 hours, 7 days, or 30 days).

B. Bring Your Own Database / Bucket (BYOD)

If you utilize BYOD mode, our Cloudflare Workers will upload the generated PDFs directly to your custom AWS bucket or database. You are solely responsible for securing your storage buckets, configuring your own lifecycle/deletion policies, and paying any associated AWS ingress/egress and storage fees incurred on your own cloud accounts.

4. Payments & API Credits

All subscription billing, tax calculation, and invoicing are handled securely by our Merchant of Record, Paddle.com. By purchasing a subscription, you also agree to Paddle's checkout terms.

• API Credits: Subscriptions grant you a specific allotment of API generation credits per billing cycle. Unused credits do not roll over to the next billing cycle.
• Overage & Pay-As-You-Go: If you exceed your plan's included limits, your service will continue uninterrupted. Any additional API requests will automatically be billed at your plan's pay-as-you-go rates.

5. Intellectual Property

Your Content: You retain complete ownership of all HTML code, Nunjucks templates, data payloads, and generated PDFs you process through Fork PDF. We claim no ownership over your documents. We do not use your data to train AI models.

Our Platform: We retain all intellectual property rights to the Fork PDF rendering engine, API, dashboard, and website code.

6. Uptime & Disclaimer of Warranties

We run on enterprise-grade infrastructure (AWS and Cloudflare) and strive for maximum uptime. However, Fork PDF is provided on an "AS IS" and "AS AVAILABLE" basis.

We make no strict guarantees regarding uninterrupted service, perfect API uptime, or bug-free rendering. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including the implied warranties of merchantability and fitness for a particular purpose.

7. Limitation of Liability

In no event shall Fork PDF be liable for any indirect, incidental, special, consequential, or punitive damages (including lost profits, lost data, or business interruption) arising out of your use or inability to use the Service, even if we have been advised of the possibility of such damages.

Total Liability Cap: Our total aggregate liability to you for any claims arising out of or relating to these Terms or your use of the Service is strictly limited to the greater of (a) the amount you paid us for the Service in the one (1) month immediately preceding the event giving rise to the claim, or (b) $50 USD.

8. Changes to the Service or Terms

We reserve the right to modify or discontinue features of the API at any time. We will notify you of material changes to these Terms via email or through the dashboard. Continued use of the Service after changes become effective constitutes your acceptance of the revised Terms.

9. Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions. You expressly agree that any legal action or proceeding arising under or relating to these Terms or your use of the Service will be brought exclusively in the competent courts located in New Delhi, India, and you hereby consent to the personal jurisdiction and venue of such courts.
